On 29 September 2026, Thailand's Board of Investment (BOI) issued press release PR168/2569, restating three relief measures for BOI-promoted companies affected by floods: duty-free import of machinery to replace damaged equipment, write-off of damaged machinery and raw materials without tax liability, and permission to increase production capacity. Applications must be submitted within six months after the flood situation ends, together with proof of loss.
The measures, titled มาตรการช่วยเหลือผู้ได้รับการส่งเสริมการลงทุนที่ได้รับผลกระทบจากอุทกภัย (assistance measures for promoted investors affected by floods), have been in force since B.E. 2567 (2024); this release restates them with guidance during the current floods.
Measure 1: Duty-free import of replacement machinery. New machinery imported to replace damaged equipment is exempt from import duty.
Measure 2: Damaged machinery and raw materials can be written off without tax liability. This is the most important of the three for BOI companies. Duty-free machinery and raw materials imported by promoted companies are subject to write-off (reconciliation) controls, and the book quantity must normally match the physical quantity. If flood damage were treated in the usual way, the shortfall could be regarded as unreconciled and the duties reclaimed. This measure states that the damaged portion can be written off without tax liability, provided the company applies through the proper procedure with proof of loss.
Measure 3: Permission to increase production capacity. Companies may apply to raise their approved capacity to make up lost production after the flood.
The company must be located in an officially declared flood area, as announced by the BOI or local government. Companies outside the declared areas need to raise their case separately even if they were actually affected.
The deadline is the part that requires immediate action: applications must be submitted within six months after the flood situation ends, with proof of loss. The six months run from the end of the flood situation, not from the date of damage; when the flood is regarded as over is determined by government notice. But it also means evidence must be secured as soon as the water recedes: the site photos, damage lists, equipment numbers and third-party assessments needed as proof of loss cannot be recreated once the site has been cleaned up.
The legal basis is BOI Announcement 15/2567 and OBOI Announcement Por. 7/2568.

The current floods have triggered several government responses. The Thai cabinet declared 28 and 29 September 2026 special holidays for Bangkok, Nonthaburi, Pathum Thani and Samut Prakan (private and state enterprises could decide for themselves); on 8 October the Ministry of Commerce's Department of Internal Trade asked suppliers of repair materials, electrical appliances and car repair services to freeze prices and keep enough goods and parts in stock. As cited by the Thai News Agency, the Bank of Thailand estimated on 30 September that the floods would reduce GDP by 0.03% to 0.1%, with services hit hardest, followed by construction and tourism.

The risk in this policy lies not in the application but in the evidence. To use the "write-off without tax liability" route for damaged machinery and raw materials, the proof of loss must match the BOI registered lists: equipment numbers, registration batches, raw material usage records and site images. Once the site is cleared, these cannot be recovered. We recommend that the first step after the water recedes is to photograph and record each item against the BOI registered list, and only then start cleaning up. Z&X BOI End-to-End Compliance Services include raw material write-off calculation and reporting and the registration of machinery and raw material lists, and can reconcile loss lists with registered data. Whether a specific case qualifies is subject to the BOI's determination.
