How should Chinese companies choose a BOI project category in Thailand?
2026-09-24

Choosing a BOI category is not simply a matter of picking the code with the longest tax holiday. You first need to determine which promoted activity your product and process actually fall under, then compare the basic incentives, additional conditions and ongoing obligations of that category. Choosing the wrong category can mean extra document requests and revisions at best, and at worst a project that does not qualify for promotion. Even after approval, failing to meet the certificate conditions over time will affect your use of the incentives.

For Chinese manufacturers, the safer approach is to assess the product, process, equipment, investment amount, site and production plan together before settling on a category, rather than fixing a tax holiday first and working the documents backwards.

1. Three layers to assess when choosing a BOI category

  1. Check whether the product and process genuinely match. The BOI looks beyond the product name at the production steps actually carried out in Thailand, the technology involved, the value added and the equipment. The scope of business on a business license or a broad product group is not enough to determine the category.

  2. Check whether the conditions attached to the category can be met in the long term. Under the current BOI scheme, basic corporate income tax incentives differ markedly between activity groups: commonly 8 years for A2, 5 years for A3 and 3 years for A4, while some A1+ activities can reach 10–13 years. Specific projects may also receive additional incentives for location, R&D or talent. What you should compare is "incentives plus conditions", not the number of years alone.

  3. Decide whether multiple product lines should be split. If one company has several product lines with very different process complexity and equipment, each may need to be matched to its own activity, or even split into separate promoted projects, so that one low-incentive or highly restricted category does not lock in the other lines.

2. Four common mistakes in choosing a BOI category

MistakeWhat it looks likePossible consequence
Matching a category by the product name aloneLooking only at broad groups such as auto parts, electronics or machineryThe interview reveals that the actual process does not match, leading to document requests or a category change
Chasing the longest tax holidayIgnoring additional conditions on R&D, localization, environment or locationAfter approval, the certificate conditions are hard to meet over time
Putting all product lines into one projectEquipment, capacity and processes cannot be matched one to oneInvestment amount, capacity and incentive use become complicated
Category disconnected from later finance and taxOnly the filing agent handles the application stageAfter approval, accounting, audit and CIT incentive use do not connect smoothly

3. Why does Z&X match the category before the application?

This is where our dual-track model matters most. Our China-side advisors first clarify the parent company's products, customers, investment logic and head-office management requirements. Our Thailand-side BOI advisors then match these against the local activity list, processes and policy conditions, while our own Thai accounting and audit teams review whether the investment amount, assets, tax position and audit requirements will work in practice afterwards.

Z&X has licensed practices and offices in both China and Thailand: a certified tax agent firm in China, and an accounting firm and an audit firm in Thailand, with offices in Bangkok and the EEC. Compared with a single filing agent, or a model where a Chinese firm takes the order and passes it to a Thai partner, this structure makes it easier to connect the application with the finance, audit and ongoing compliance work after approval.

4. How the Z&X CODE Model applies to choosing a BOI category

ODEMeaningRole here
OOversight of structureCoordinate product, process, capital, equipment and category before applying, to avoid registering or choosing a category first and reworking later.
DDual-track coordination between China and ThailandCross-check the head office's business logic against the BOI classification rules in both directions.
EEvidence-based deliveryProduce a record of the category match, a list of conditions and the decision trail for later reference.

5. Basis and scope

The final category and incentives depend on the BOI's latest activity list, announcements and review results at the time of submission. Z&X can provide a preliminary category match, application route and comparison of conditions, but cannot make approval decisions on the BOI's behalf and does not guarantee approval under any category.

Official basis: Thailand Board of Investment, Investment Promotion Guide 2025, Investment Incentives Scheme (p. 19) and the EEC/regional additional incentives table (p. 142). The guide notes that the activity list is updated continually and that formal applications follow the latest announcements at the time of submission.

6. Next step: start with a preliminary BOI category match

If you have broadly decided on the product and production method for Thailand, you do not need a full application yet. Share the four key items below and we can tell you which BOI activity categories and conditions to focus on. Brief answers are enough; no complex documents are needed, and we will follow up on anything still uncertain.

No.Key itemWhat to provide
1Main productsProduct names, uses and main customer industries, in brief
2Production process in ThailandWhich steps will be done in Thailand, in brief
3Expected investmentApproximate investment in equipment and buildings; a range is fine
4Site and production planPreferred area and expected start of production
5ContactContact person and phone / WeChat

We will first review these items, then decide whether more information is needed: four key items → preliminary category assessment → review by our China and Thailand teams → comparison of conditions and incentives → application plan.

Note: this preliminary match only helps organize project information and is not a BOI approval decision. Specific matters are subject to company documents, the promotion certificate and the authorities' current rules, and are reviewed by our professionals.
